These are the General Terms of Use of the Medical University of Vienna (short "MedUni Vienna") for the use of the portal www.phototox.org.

We invite you to read the Terms of Use at your leisure, as they contain important information and regulations for the use of Phototox.org.

1. General information

1.1 MedUni Vienna operates a portal at the web addresses www.phototox.org , on which it provides information on photosensitivity and photocarcinogenicity of drugs and agents based on literature. This page is referred to below as “Phototox-Website”.

1.2 The Phototox-Website provides an overview of the photosensitivity and photocarcinogenicity of selected medicinal products and contains general information about the medicinal product.. All information has been carefully checked and verified by means of literature references, but no responsibility is taken for correctness and completeness.

1.3 The contents published on the Phototox-Website are for information purposes only and in no way replace professional medical training, or advice and treatment by a physician.

1.4 The information offered by Phototox-Website is directed exclusively at users with a medical profession.

1.5 The use of Phototox-Website is exclusively on the basis of these instructions for use in the currently valid version.

1.6 When using the Phototox-Website you agree to show your username and when leaving a comment.

2. Costs

2.1 The offer of Phototox.org is currently made available free of charge. However, MedUni Vienna reserves the right to make the offer subject to a charge at any time after prior announcement. There is no entitlement to the provision of services free of charge.

3. Procedure in the event of contradictory information

3.1 Should there be any contradictions with regard to the specialist or user information and information on the Phototox-Website accompanying treatment or diagnostic modalities, the details provided by the treating physician shall apply exclusively. In such a case, urgent consultation with the treating physician is recommended.

4. Warranty, Liability

4.1 MedUni Vienna makes every effort to ensure that the data and information made available on the Phototox-Website is correct and complete. However, MedUni Vienna does not accept any liability for the accuracy, completeness and topicality of the data and information contained on this website - insofar as this is legally permissible. In particular, no liability whatsoever is accepted for any direct or indirect damage resulting from the direct or indirect use of the content made available on the Phototox-Website.

4.2 MedUni Vienna reserves the right to change the Phototox-Website at any time and without giving reasons or to cease its operation. The user shall have no claims whatsoever as a result.

4.3 It cannot be guaranteed that the Phototox-Website will always function without interruption, punctually or without errors or that errors on the site will be corrected immediately. MedUni Vienna accepts no responsibility for any failures, interruptions or malfunctions, deletions, faulty transmissions or a memory failure.

4.4 No warranty is provided regarding fitness to pass specific medical board examinations or professional certifications.

5. Links to external websites of third parties

5.1 The Phototox-Website contains links to external websites of third parties, over whose content MedUni Vienna has no influence. For this reason, no guarantee can be given for these external contents. Without exception, the respective provider or operator of the sites is responsible for the content of the linked sites. MedUni Vienna is therefore responsible neither for the content, nor the availability, correctness, accuracy or topicality of these websites or their offers.

5.2 Permanent monitoring of the content of the linked sites is not reasonable without concrete evidence of a violation of the law. However, if infringements of the law become known, the corresponding links will be removed immediately.

5.3 The inclusion of links to external websites of third parties in the Internet portal operated by MedUni Vienna is only provided as an additional service for the user. Insofar as links refer to external websites of third parties, this does not represent any recommendation or guarantee with regard to the services offered or contained therein, in particular information and any goods or services offered.

6. Copyright, rights of exploitation and use

6.1 All rights, such as copyright, to the content, works, logos, graphics, names and other documents and materials published on Phototox-Website are the property of MedUni Vienna. This does not apply to publications in which another author is expressly named.

6.2 All services offered on Phototox-Website may be used exclusively for non-commercial educational use, whereby MedUni Vienna reserves the right to revoke the rights granted for this purpose at any time. Commercial use of the services offered on Phototox-Website, in any way whatsoever is expressly prohibited. The original version of the descriptions shown on phototox.org were based on the diploma thesis of Aylin Sezer.

6.3 Automated spiders, bots and networks are not allowed to scrape website contents. The MedUni Wien reserves the right to block access of users, user agent profiles, and/or associated IP addresses in such events.

7. User provided content

7.1. Where applicable, a user may voluntarily provide content such as comments, annotations, on Phototox-Website.

7.2. By uploading, the user grants MedUni Wien the non-exclusive, perpetual, transferable, royalty-free, worldwide, right to use, modify, translate, copy, reproduce distribute, print, publicly perform, publish and make available this material for the purpose of research and teaching.

7.3. By uploading, the user guarantees that he/she is authorized to provide the content and that the uploaded content is free from third party rights.

7.4. Wherever we notice copyright or privacy infringement or otherwise illegal content, we reserve the right to archive such material wherever legal requirements necessitates, and otherwise delete such content and users without prior notice.

7.5. Users are liable for any copyright or privacy infringements or violations of applicable law caused by uploaded material.

8. Final provisions

8.1 For any disputes arising in connection with the use of Phototox-Website, Austrian substantive law shall apply. Consumers with residence or habitual abode in the EU, also enjoy the protection of the mandatory provisions of their country of residence.

8.2 As non-exclusive place of jurisdiction, the respective competent court for the 9th district of Vienna, Austria, is agreed. This means that for disputes in connection with the use of the Services arising from consumer protection, the place of jurisdiction shall optionally be Vienna, Austria or the place where the consumer has his residence or habitual abode.

8.3 Should individual provisions of these terms of use contradict the legal regulations, be invalid or impracticable, the remaining provisions shall remain unaffected. They shall be replaced by the permissible provision which comes closest to the intended purpose.

8.4 MedUni Vienna is entitled to make changes to these instructions for use and to the data protection declaration at any time and without stating reasons. MedUni Vienna shall announce these changes as well as the date of entry into force in each case on the Phototox-Website in the current instructions for use or the current data protection declaration. The current version of the instructions for use and the data protection declaration can be viewed at any time at www.Phototox.org/tos or https://www.Phototox.org/dp. We recommend that you archive the Terms of Use and the Privacy Policy in their current version.

8.5 MedUni Vienna reserves the right, irrespective of Section 2, to issue additional instructions for use or general terms and conditions for new services and in particular for services for which a charge is made.
